LIMITED WARRANTY FOR COMPONENTS

ALTERNATIVE FUEL SYSTEMS, INC.

AFS located at 3232 South Nordic Road, Arlington Heights IL., 60005-4771, USA warrants all AFS products to be free of defects in material and workmanship for a period of twelve (12) months or 2000 hours which ever comes first, commencing from date of manufacture. The sole obligation of AFS under the terms of this warranty is limited to replacing or repairing any AFS product which, under normal conditions of use and service, proves to be faulty due to any defect in material or workmanship. If AFS is unable to repair or replace after a reasonable number of attempts AFS will provide a full refund of purchase price. These remedies are the only remedies for breach of warranty. This warranty does not cover labor costs incurred in the diagnosis of defects, removal or reinstallation of the equipment nor does it cover any other contingent or consequential expense including freight to return the product. All returns must be authorized by AFS via a RMA number which is assigned by AFS. All product received without an authorized RMA number will be sent back to the sender collect.

This warranty is limited to the original end user only. Specifically excluded from this warranty are products which have been subjected to neglect, abuse, improper application, unsuitable installation environment, unauthorized attachments or modifications, or damage caused by disasters such as fire, flood, wind, and lightning. Also excluded are products which have been repaired or adjusted by persons other than an authorized or contractual AFS service representative and AFS products in which parts or products other than those manufactured or supplied by AFS have been used unless the original end user can demonstrate to the satisfaction of AFS that said repair or use of non-AFS products has in no way contributed to the warranty claim.

UNDER NO CIRCUMSTANCES WILL AFS BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL OR SPECIAL DAMAGES BASED ON BREACH OF WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, STRICT LIABILITY, TORT, OR ANY OTHER LEGAL THEORY OR ANY EXPENSES INCURRED BY REASON OF THE USE OR SALE OF ANY SUCH PRODUCT WHICH INCLUDE BUT NOT LIMITED TO LOSS OF PROFIT, LOSS OF SAVINGS OR REVENUE, LOSS OF USE OF PRODUCT, COST OF CAPITAL, COST OF ANY SUBSTITUTE EQUIPMENT, FACILITIES, OR SERVICES OR DOWNTIME OR THE CLAIMS OF THIRD PARTIES INCLUDING CUSTOMERS AND INJURY TO PROPERTY.

THERE ARE NO EXPRESS WARRANTIES OTHER THAN SET FORTH IN THIS DOCUMENT. THE WARRANTIES CONTAINED HEREIN ARE IN LIEU OF ALL OTHER WARRANTIES IMPLIED BY STATE LAW, WHETHER MERCHANTABILITY OR FITNESS FOR A PARTICULAR APPLICATION OR FITNESS FOR A PARTICULAR PURPOSE OR USE OR OTHERWISE.

Some states do not allow limitations on how long an implied warranty lasts, therefore the above limitation may not apply to you. In addition, some states do not allow for the exclusion or limitation of incidental or consequential damages therefore the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights and you may have other legal rights which vary from state to state. This agreement allocates the risk of product failure between AFS and the original end user. This allocation of risk is recognized by both parties and is reflected in the price of the product.

Information in AFS catalogs or other documents is given after the exercise of due care in its compilation, preparation, and issuance; however, AFS DISCLAIMS ANY LIABILITY RESULTING FROM SUCH INFORMATION except for the obligation under the warranty provided above to replace or repair the product or, at AFS's option, to refund the purchase price.
